1. Terms
1.1 These terms apply from the time you make a booking to attend the trip.
1.2 By placing your booking for the trip either online or by email you accept and agree to abide by these terms and conditions.
1.3 We may add to, change or remove any of the terms and conditions or other clauses within this document. The most up to date version of these terms will always apply.
Any notice will be provided of any change to these terms by: putting a notification on our website; publishing the new document on our website; directly via email.
2. Travel Arrangements
2.1 The trip includes the specified accommodation, workshop, activities, transportations and specified meals.
2.2 The trip does not include travel and gear insurance, visa fees, air fares or any other travel costs outside of the specified.
2.3 It is your responsibility to ensure that you have a valid passport, visa and re-entry permits which meet the requirements of the immigration and other government authorities in the trip locations (travel documents). By making a trip booking with us you warrant that you have all travel documents required to attend the trip. Any fines, penalties, payments or expenditures incurred as a result of travel documents not meeting the requirements of those authorities will be your sole responsibility.
2.4 It is your responsibility that you take out appropriate travel insurance for the duration of the trip.
2.5 It is your responsibility to familiarise yourself with any health requirements and recommended precautions relevant to your travel to our trips and ensure that you carry all necessary vaccination documentation.
3. Health and Age
3.1 You must be at least 18 to participate in the trip.
3.2 Upon each booking of a trip, and each time you attend one of our trips and participate in trip related activities, you warrant that you are in good medical and physical condition.
3.3 We reserve the right to refuse you from participation in an upcoming trip (that has not departed), from parts of a trip (that has departed), or related trip activities, without refund, if:
(a) we perceive a reasonable risk of injury to you or any other person due to your participation; or
(b) we perceive that you have an infection, covid-19, contagious illness; or
(c) we perceive your behavior to be aggressive, disruptive, antisocial, discriminatory, predatory, illegal or in any way inappropriate to the well-being of other travellers, or staff, and the overall trip experience prior, during or after the trip; or
(d) we perceive your behavior to be threatening, or violent; or
(e) you do not adhere to community guidelines.
4. Limitation of liability
4.1 We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law. Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities.
4.2 In other circumstances, we are responsible to you for the proper performance of this contract.
4.3 We shall not be liable for any damage or loss if the failure to carry out the contract is:
(a) attributable to you.
(b) attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.
(c) due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.
(d) due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
(e) due to an event which the Company, even with all due care, could not foresee or forestall.
4.4 Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to 3 times the price paid. In the case of damaged property, the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases, the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.
4.5 Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation, the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions.
5. Fees
5.1 Our current fees for our trips are available on our website.
5.2 To secure your spot on all trips, you must pay a non-refundable deposit. This is due to the prepaid nature that we must adhere to at our venues.
5.3 A 500 Euros deposit is required to confirm your booking within 48 hours and this will be non-refundable in all circumstances.
5.4 Remaining / final balance (trip cost minus deposit) is due 14 days prior to the start date of the trip.
5.5 If you book 14 days or less prior to the start of the trip, you must pay full amount at time of the booking.
5.6 The payment of final balance of fees for your trip is to be paid via Transferwise, PayPal or bank transfer.
5.7 Transfer of bookings for our trips need to be notified via email to nancy@spacesxplaces.com
5.8 Please note that a surcharge may be applied to all purchases made by credit card.
5.9 There will be no refunds of trip fees in any circumstances except for those listed below.
5.10 If the remaining balance that excludes the non-refundable deposit is not paid on or before the due date we reserve the right to treat your booking as canceled.
6. Cancellation by the traveler
6.1 We do not offer refunds outside of those listed below. This is due to the prepaid nature that we must adhere to at our venues.
(a) Your deposit is non-refundable in all circumstances.
(b) If you cancel 30 days or more prior to the trip, you can receive the full amount paid, with exclusion of the non-refundable deposit.
(c) If you cancel 30 days or less prior to the trip, you will forfeit all payments made towards the trip.
6.2 Exceptions to our policy cannot be made for any reason.
6.3 All cancellations must be made in writing via email to nancy@spacesxplaces.com; the deposit is non-refundable and is subject to the refund policy – listed above.
7. Cancellation by us
7.1 We may cancel the trip if a minimum quota of attendees has not been reached within 3 weeks prior to trip date. Minimum quota of attendees dependent on trip.
7.2 We may cancel the trip at any time prior to departure and we shall not be liable for it if due to natural disasters, war, terrorism, closure of airports, civil strike, accidents or other external events it is not viable for us to operate the planned itinerary.
7.3 If we cancel the trip, you can transfer the amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs.
7.4 We are not responsible for any expenses incurred in preparation for any cancelled trip, such as airline tickets, loss of work, and/or other costs associated with preparation for your trip. It is suggested to get travel insurance as soon as you have paid the deposit.
7.5 Please note that a surcharge may be applied to all refunds made by credit card.
8. Optional activities
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.
9. Privacy policy
Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip. We will otherwise treat your details in accordance with our privacy policy.
